Agreement to Terms
By submitting cases to, or engaging the services of, Bermuda Dental Studio ("BDS"), the referring dental practice ("Client") agrees to these Terms of Service.
Services Provided
BDS provides dental laboratory services as described on this website and in individual prescriptions. All services are provided to licensed dental professionals only. BDS does not provide services directly to patients. BDS reserves the right to decline any case that falls outside its current clinical capabilities.
Prescriptions
The Client is responsible for providing accurate, complete prescriptions for all cases. BDS produces appliances to the specifications provided. BDS is not liable for outcomes resulting from incorrect or incomplete prescriptions. Prescription errors identified during production will be flagged before work proceeds.
Quality and Warranty
BDS warrants that all work is produced to professional dental laboratory standards. Dentures (excluding immediate dentures) carry a 6-month warranty against manufacturing defects. Warranty does not cover damage from misuse, patient non-compliance, or conditions outside BDS control. Warranty claims must be submitted within 30 working days of delivery.
Remakes
Remakes required due to BDS error are produced at no charge. Remakes required due to prescription error, changed clinical parameters, patient preference, lost or damaged appliances, or faulty impressions are charged at standard rates. Shade remakes are charged up to the original case price. Cases requiring precious metal returns will be charged 40% of the metal value.
Rush Orders
Rush cases are accepted subject to capacity and must be confirmed with BDS before submission. Rush surcharges apply. BDS will not accept rush cases that cannot be completed to standard quality within the requested timeframe.
Payment
Invoices are issued per case on completion and sent biweekly. Payment is due within 15 days of invoice date. Accounts unpaid beyond 30 days may accrue a 5% monthly finance fee. Accounts with persistent overdue balances may be referred to a collections agency. BDS reserves the right to hold cases pending payment on overdue accounts.
Third-Party Production
Fixed prosthetic cases submitted through the Epic Dental joint venture program are produced by Epic Dental Studio (Utah, USA). BDS facilitates case submission, on-island adjustment, and delivery. Quality standards and warranty terms for Epic cases follow Epic Dental's applicable policies. BDS provides contact and shade adjustment services on arrival.
Liability
BDS liability for any case is limited to the value of the case in question. BDS is not liable for patient outcomes resulting from the clinical use of prosthetics produced to specification. BDS is not liable for choking hazards or misuse of dental appliances. BDS is not liable for damage occurring after delivery to the referring practice.
Governing Law
These Terms are governed by the laws of Bermuda. Any disputes arising from the provision of BDS services will be subject to the jurisdiction of Bermudian courts.
